History of noise in law

Arbitration and litigation

Noise from industrial, leisure and domestic activities has become a significant cause for concern, particularly in residential areas. When the planning process cannot be used to prevent disturbance, the Environmental Protection Act and, for construction noise, the Control of Pollution Act can be used to control such noise.

Our work in the field of litigation includes advising those affected by, or causing, excessive noise on suitable means for mitigation and, where appropriate, providing Expert Witness evidence in Court.

Where contractual disputes involve noise, vibration or other acoustical issues (such as whether acoustic elements meet the contract specification), the Practice has also provided advice and Expert Evidence for arbitration proceedings.
